Commissioner Adams referred to page 5 of the proposed agreement, Section X.B., <br />Reuse of Documents. She felt that once the County has paid nearly $90,000 for the work, <br />the documents should become the property of the County. In reading the paragraph it <br />seemed to her to say that the consultant would have to be paid again for any reuse of the <br />documents. <br />County Attorney Vitunac thought that was standard for the business but was an item <br />that could be bargained if the Commissioners did not like the provision. <br />Commissioner Ginn also objected to the provision saying that the County would be <br />paying for it and should get the documents. <br />Coastal Engineer Jeff Tabar explained that an additional statement was placed in <br />Section X, Ownership and Reuse of Documents, specifically for this with the intention that <br />they are developing a reporting program for us for the Beach Preservation Plan. Obviously, <br />it is possible in the future we may have to re -use those documents to generate funding or re- <br />establish the funding. The additional statement was placed in there, and the consultants <br />were aware of it. The documents cannot be used for projects unrelated to the intent of the <br />funding program; anything that it was developed for in the intended use of the documents <br />would be allowed in the future. <br />Commissioner Eggert thought it might be necessary to get that conflict out of the <br />agreement, and Commissioner Ginn agree that should be done. <br />Commissioner Adams reiterated her belief that once we pay for the documents, they <br />should be able to be used by us in any way we want. <br />County Attorney Vitunac advised his office would redo the document with that <br />direction in mind and send it back to the consultant for their concurrence. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously agreed to direct <br />staff to amend the agreement with Applied Technology and <br />Management, Inc. to clearly protect the County for the future re- <br />use of the documents. <br />AGREEMENT IS ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />July 28, 1998 <br />47 <br />BOOK 106 FACE <br />
