INDIAN RIVER CLUB REUSE MAIN DEVELOPER'S <br />AGREEMENT - FINAL RECONCILIATION <br />INDIAN RIVER COUNTY PROJECT NO. CDS/CCS-890 <br />BACKGROUND <br />On January 19, 1995, the Indian River County Board of County Commissioners <br />approved the above -referenced developer's agreement with the Indian River <br />Country Club. (See attached agenda item and minutes.) On November 19, <br />1996, the Indian River County Board of County Commissioners approved a <br />modification to this agreement for additional construction and engineering <br />expenses. This addition was primarily due to additional requirements placed <br />on the County by the Department of Environmental Protection. (See attached <br />agenda item and minutes.) The project is now complete, and we wish to <br />proceed with finalization of the developer's agreement. <br />ANALYSIS <br />The original estimated costs associated with this agreement approved by the <br />Board on November 19, 1996 are as follows: <br />Construction $67,475.00 <br />Original Engineering 4.247.50 <br />$71,722.50 <br />' Additional engineering for County with M&M 6.200.00 <br />$77,922.50 <br />' DEP requirements (reference November 19, 1996 agenda item and minutes) <br />The final project costs are as follows: <br />Final Construction $70,822.00 <br />Final Engineering 5.343.38 <br />Sub Total $76,165.38 <br />" Additional Construction (October 17, 1994) 6.750.00 <br />Total requested by Indian River Country Club $82,915.38 <br />See attached letter and backup from Bob Swift dated May 13, 1998 <br />The additional requested funding for the project completed on October 17, <br />1994 by the Indian River Club was not previously discussed with the County. <br />Although not notified in advance, the construction did benefit the County. The <br />options available to the County in this matter are as follows: <br />1. Reimburse the developer for the final construction cost covered under the <br />existing agreement in the, amount of $76,165.38 (this equates to a final <br />project cost increase of 6.2%). <br />2. Reimburse the developer as he has requested in the amount of $82,915.38. <br />The staff of the Department of Utility Services recommends approval of Option <br />2 to allow finalization of this project. <br />OCTOBER 6, 1998 <br />0 <br />
