9. Landscape Plan: The landscape plan is in conformance with Chapter 926. This includes <br />a Type "D" buffer along the site's eastern property line, as required for civic and cultural <br />facilities in the RM -10 district. Much of the required landscaping will be met by the <br />preservation of existing material. However, significant new landscape material will be added <br />along all project perimeters and in the area of new constriction. <br />10. Utilities: The project will be serviced by county water and sewer. These utility provisions <br />have been approved by the County Department of Utility Services and the Environmental <br />Health Departmen. <br />11. Dedication and Improvements: <br />■ Pursuant to the County's comprehensive sidewalk and bikeway plan, a sidewalk is <br />required along the project's U S 1 frontage. The sidewalk is depicted on the plans <br />and will either need to be built or bonded -out prior to the issuance of a Certificate of <br />Occupancy. <br />■ Presently, the Indian River Farms Water Control District (1RFWCD) and the county <br />Utilities Department use this site to access the south relief canal right-of-way for <br />maintenance and for access to utility unprovements. The applicant is proposing <br />improvements within an existing 15' access easement that the District and Utilities <br />Services use for access. The improvements should not affect the use of the access <br />easement. There will be reciprocal agreements between the District, Utilities <br />Department and McKee Gardens which make provisions for formal access in <br />coordination with the new development on-site. These agreements will need to be <br />in place (executed) prior to site plan release. <br />12. Concurrency: The developer has executed a concurrency aclmoledgment agreement which <br />satisfies the project's concurrency in relation to site plan approvaL <br />13. Environmental Issues: <br />■ Wetlands: There are several small isolated wetlands on the site that will be <br />enhanced as part of the project. No wetlands alteration permitting is <br />required. <br />• Uplands: Although the site is over 5 acres, the environmental planning staff has <br />evaluated the site and determined that much of the vegetation is non- <br />native and that no part of the site constitutes a native upland <br />community. Therefore, no native upland set aside is required. <br />14. Surrounding Land Use and Zoning. <br />North. Vista Gardens Trail / CG <br />South: Indian River Farms South Relief Canal, Commercial and <br />Multi -Family / CL, RM -10 <br />East. Multi -Family Units / RM -10 <br />West: U S 1, FEC RR, Mobile Home Park / RMH-6 <br />15. Historic Preservation: The two historic structures on the site, the Hall of Giants and the <br />Spanish Kitchen, are being restored as part of a separate project. These buildings were <br />designed by Waldo Sexton. The historically significant garden landscape design by William <br />Lyman Philips is being restored where intam <br />16. Specific Land Use Criteria: The following specific land use criteria apply to the portion of <br />the Botanical Garden in the RM -10 zoned portion of the site: <br />1.
