Collins II - [deputy County Attorney <br />DATE: December 17, 1998 <br />SUBJECT: Additional Security for Phase III of Atlantic Coast Enterprises, Inc. <br />Sand Mine <br />Indian River County approved a sand mine operation for Atlantic Coast <br />Enterprises, Inc. in the unincorporated area of Sebastian. The mine is being <br />developed in phases. The developer has transferred a $32,700.00 performance <br />bond to guarantee compliance with the site plan and restoration of the site from <br />Phase I to Phase III as permitted by the Code. (A separate cash bond secures <br />Phase II compliance and restoration.) <br />Because the mine area of Phase III is 2.3 acres larger than Phase 1, additional <br />security for compliance and restoration in the amount of $2,300.00 is required by <br />Code. <br />Attached is a Cash Deposit and Escrow Agreement with respect to the sand <br />mine as supplemental security for Phase III. <br />RECOMMENDATION: <br />Authorize the Chairman to execute the Cash Deposit and Escrow Agreement <br />SP -MA -95-04-17 for Phase III supplemental security. <br />JANUARY 5, 1999 <br />-14- <br />
