A site plan or temporary use permit must be approved by the planning department; <br />Any improvements made to the leased site must be done and paid for by the lessee <br />with the improvements reverting to the county when the lease expires. <br />Comprehensive plan amendment requests are reviewed for consistency with all policies of the <br />comprehensive plan. As per section 800.07(1) of the county code, the "comprehensive plan may be <br />amended only in such a way as to preserve the internal consistency of the plan pursuant to section <br />163.3177(2).F.S." <br />The goals, objectives and policies are the most important parts of the comprehensive plan. Policies <br />are statements in the plan that identify the actions which the county will take in order to direct the <br />community's development. As courses of action committed to by the county, policies provide the <br />basis for all county land development decisions. While all comprehensive plan policies are <br />important, some have more applicability than others in reviewing plan amendment requests. Of <br />particular applicability for this amendment request. is the following policy: <br />Future Land Use Policy 14.3 <br />The most important policy to consider in evaluating a plan amendment request for consistency with <br />the county's comprehensive plan is Future Land Use Element Policy 14.3. This policy requires that <br />one of four criteria be met in order to approve a land use amendment request. These criteria are: <br />• a mistake in the approved plan; <br />• an oversight in the approved plan; <br />• a substantial change in circumstances affecting the subject property; or <br />• a swap or a reconfiguration of land uses at separate sites. <br />The following table shows how this comprehensive plan amendment relates to Future Land Use <br />Element Policy 14.3. <br />Objective/Policy <br />Correct a <br />mistake <br />Correct an <br />oversight <br />Change in <br />circumstances <br />Swap of land <br />uses <br />Coastal Management Policy 5.1 <br />X <br />Economic Development Policies <br />X <br />X <br />Future Land Use Policy 6.1 <br />X <br />Future Land Use Policy 14.3 <br />X <br />Recreation and Open Space <br />Policy 7.3 <br />X <br />Coastal Management Element <br />Based upon its analysis, staff feels that the proposed change to policy 5.1 of the Coastal Management <br />Element meets the first criterion of policy 14.3 of the Future Land Use Element. As revised, policy <br />5.1 contains the correct FAC citation. <br />Economic Development Element <br />Based upon its analysis, staff feels that the proposed changes to the Economic Development Element <br />meet two of the criteria of Future Land Use Element policy 14.3. <br />Many of the Economic Development Element's policies that are being deleted are policies that <br />duplicate actions of other policies. Other policies that are being deleted are policies which did not <br />have a defined action. That constitutes a mistake in the comprehensive plan. Therefore, the <br />proposed changes meet the first criterion of Policy 14.3. <br />There has also been a change of circumstances that supports the proposed revisions to the Economic <br />Development Element. That change relates to the Economic Development Division's experience <br />in marketing the county's economic development potential. Because of that experience, the <br />Economic Development Division has identified more efficient and cost effective marketing <br />activities.
