The County staff would <br />review and approve all costs. <br />ONMOTIONby Commissioner Ginn, SECONDED <br />by Commissioner Adams, the Board unanimously <br />approved allocating not -to -exceed $89,700 from <br />Secondary Road Improvement Fund 109 for <br />construction of a southwesterly extension of College <br />Lane to the proposed Richardson Center Building, as <br />recommended by staff. <br />11.GA FLEET MANAGEMENT COMPLEX PROPERTY <br />ACQUISITION - ANNETTE ROBERTS, TRUSTEE - JOINT <br />VENTURE WITH SCHOOL DISTRICT <br />The Board reviewed a Memorandum of May 5, 1999: <br />TO: James E. Davis, P.E., <br />Public Works Director <br />SUBJECT: Fleet Management Complex Property Acquisition - <br />County/School District Joint Venture <br />DATE: May 5, 1999 <br />DESCRIPTION AND CONDITIONS <br />Last March, the Board approved an Option Agreement for the purchase <br />of a ±25 acre Parcel on South Gifford Road for a joint <br />County/School District Fleet Management Complex, Fueling Depot, and <br />Bus Storage area. Page six of the Option Agreement contained <br />paragraph 30 "Shared Cost," which stated that "the Option shall not <br />be considered executed by the purchaser until approval by the <br />School Board." Page seven of the option contains a signature block <br />for the School Board, and Page eight includes a notarized <br />acknowledgment for the School Board. <br />On April 27, 1999, the School Board approved purchasing a portion <br />of the property from the County, but the School Board attorney did <br />not recommend that the School Board sign the Option due to alleged <br />title and estate problems. The Realtor for the seller has <br />indicated that the alleged estate problems will be resolved. The <br />Option Agreement requires any title defects be resolved prior to <br />closing. Eric Barkett, Attorney for the seller, has spoken with <br />Russ Peterson, School Board Attorney, and it appears that the <br />issues are resolved. Attorney Peterson has prepared language <br />attached herewith which clarifies the School District's position. <br />MAY 189 1999 <br />-62- <br />
