(� <br />Senior Planner, Current Development <br />DATE: August 11, 1999 <br />SUBJECT: Earring Point Groves Request for Abandonment of a portion of 87`6 Street <br />Right -of -Way in the Wabasso Area <br />It is requested that the data herein presented be given formal consideration by the Board of County <br />Commissioners at its regular meeting of August 17, 1999. <br />� 1MIN_ <br />Earring Point Groves has submitted a petition to abandon a portion of "excess" 87th Street right-of- <br />way located on the south side of 87th Street between US #1 and CR 510. The subject "excess" right- <br />of-way extends south from the principal alignment of 87th Street into a parcel that is located between <br />US #1 and CR 510 (see attachment #2). Recently, the Board of County Commissioners approved <br />Christ Presbyterian Church's request for special exception use and conceptual site plan approval to <br />construct a church on that parcel. The approved conceptual plan proposes use of the to -be - <br />abandoned right-of-way and is conditioned upon abandonment of the subject right-of-way. The <br />subject right-of-way measures 19.04' deep at the west end by 434' long by 68' deep at the east end. <br />The applicant is requesting that the subject segment of right-of-way be abandoned to make the <br />subject site more developable. If the right-of-way is abandoned, it will be added to the property <br />south of 87th Street that is under contract to the church. The Board of County Commissioners is now <br />to consider the abandonment request. <br />The subject "excess" right-of-way area has never been used for 87th Street roadway purposes and is <br />presently planted in citrus. If this right-of-way were abandoned in its entirety, a 50' wide righf-of- <br />way would remain for the section of 87th Street that fronts the subject parcel. This segment of 87th <br />Street is classified as a local road, which requires a total 60' of right-of-way, and 5' of the strip of <br />right-of-way that is to be abandoned is part of the overall 60' needed for 87th Street right-of-way. <br />Therefore, in accordance with the LDW s, the Public Works Department has recommended that a 5' <br />wide drainage, utilities, and roadway easement be retained. Retaining such an easement will make <br />this request of 87th Street right-of-way conform to the county's local road standard. <br />Per guidelines established by the Board of County Commissioners, this petition was reviewed by all <br />county divisions and utility providers having jurisdiction or potential interests within the right-of- <br />way. In addition, per county regulations, adjacent property owners were notified by mail prior to <br />staff s application review meeting (the Technical Review Committee meeting of June 21, 1999). <br />No objections have been received from any adjacent property owner. All reviewing agencies and <br />departments have recommended approval of the requested abandonment, with the condition that an <br />easement for utilities, drainage, and roadway use be reserved over the north 5' of the abandoned area. <br />The subject right-of-way is not part of the roadway system as noted on the County Thoroughfare <br />Plan, and is not needed for the thoroughfare I system. Furthermore, the abandonment would not affect <br />the right of convenient access to surrounding properties. Also, the County Attorney's Office has <br />reviewed and approved the attached abandonment resolution for legal form and sufficiency. <br />AUGUST 17,1999 <br />36 <br />0 <br />
