rCOOKPAGE <br />• limit private observation /fishing piers to a water depth of two feet mean high water <br />(MHW) or less <br />• require appropriate signage on all private observation/fishing piers stating prohibition <br />of boat mooring <br />• limit maximum length/projection of private observation/fishing piers to 35 feet <br />beyond water's edge (MHW line) or 25% of the waterway's width, whichever is less <br />• require railings with pickets or similar bars along the water -ward sections of the <br />access walkway and terminal platform (as a deterrent to boat dockages) <br />• require the deck to be at least five feet above MHW <br />• prohibit private observation/fishing piers in the Pelican Island National Wildlife <br />Refuge (due to overriding public interest) <br />It is staffs position that it would be appropriate to incorporate these conditions into LDR Chapter <br />932, Coastal Management, the chapter that currently contains regulations for single-family docks. <br />Staff is requesting Board authorization to set a public hearing for adoption of an amendment to <br />Chapter 932 (and Chapter 901, Definitions) relating to allowance of private observation/fishing piers <br />subject to the conditions specified above. <br />■ Public Hearing for the Amendments <br />Both proposed amendments can be considered at the same public hearing. The proposed <br />amendments may be adopted at a regular Board of County Commissioners meeting, subject to <br />required public advertizing timefirames. One hearing date that would meet such timeframes is the <br />regular Board meeting of September 28, 1999. <br />Staff recommends that the Board of County Commissioners set a September 28, 1999 public hearing <br />date, or any other date that complies with advertizing timeframes, for adoption of the proposed LDR <br />amendments related to Wabasso Corridor Plan requirements and private piers. <br />1. August 23, 1999 Wabasso Corridor Meeting Summary <br />Planning Director Stan Boling briefly reviewed the above memorandum. <br />In response to Chairman Macht's concerns about the penalty for using a pier for a <br />dock, County Attorney Vitunac stated that penalties will depend on how the case is <br />prosecuted. If prosecuted by the Code Enforcement Board, the penalty would be to correct <br />SEPTEMBER 7, 1999 <br />78 <br />
