Tillis _appeared before the Board and requested. the- County, to have her <br />dwelling repaired as it was badly in .need of repaira.. On'motion.made .by.C. S. Michael, Se <br />by S. E. Glover and carried.it was so ordered and Frank A. might, Road -Superintendent was <br />instructed to have said.-- repairs made. <br />Commissioner C. S. Michael delivered a check for $26.08 representing , refund. of <br />serum.used on employees of the Deer Field Groves and it was ordered that this amount be placed <br />in the General Rgvenue.Fund. <br />Mr. George James appeared.b efore the Board and requested the County to accept title <br />to the Minter Beach Cemetery in order that a W. P. A. project-.might.be-.obtained fnr said cem- <br />etery. It was moved by S. E. Glover, seconded by Frank C. Vickers.and carried..that_the County <br />accept title to the Winter Beach'Cemetery and sponser a W. P. A. project in order to improve <br />the present condition of the cemetery. <br />It was ordered that transportation be furnished for approximately 7 boys to the C.C.( <br />Camp at West palm Beach and Frank A. Knight, Road Superintendent was instructed accordingly. <br />Douglas Baker, Clerk, was instructed to write Hon. Angus Sumner, Assistant State <br />Attorney, and request his presence at the next regular meeting of this Board. <br />The Chairman appointed W. R. Duncan, Charles A. Mitchell and Frank C. Vickers as a <br />committee to investigate the possibility of the County obtaining some land bordering on Blue <br />Cypress Lake. <br />Bids on gas & oils were received.from the American -Oil Company, Sinclair refining <br />Company and the Standard ail Company. On motion made by S. E. Glover, seconded by Frank C. <br />Vickers and carried it was ordered that Sinclair refining Company be awardered this business <br />for a six months period ending December 31st 1938. <br />It was reported t#e bath house at Wabasso was gradually being destroyed and on moti <br />made by C. S. Michael, seconded by S. E. Glover and carried it was ordered the County post a <br />$100.00 reward for the conviction of any person or persons defacing, destroying or injuring <br />said bath house. <br />to wit: <br />RESOLUTION <br />Commissioner Michael introduced the following resolution and moved its adoption, <br />Khereas, Johnny Smith was convicted bf murder in the first degree, in the year 1936, <br />in the fall term of the Circuit Court in and for Indian River County, Florida, and at such <br />term of said Court was sentenced to death by the Judge of such Court; and <br />Whereas, the said Johnny Smith did take his writ of error from said judgment to the <br />Supreme Court of Florida, and said Court has long since affirmed the judgment of the lower <br />Court; and <br />Whereas, many months have passed and the said Johnny Smith remains in the County Jail <br />of Indian River County, Florida, at the expense of the taxpayers of said County, and because it <br />appears that no death warrant has been signed by the Governor of Florida under which the said <br />Johnny Smith could be removed from the.County Jail of Indian River County, Florida and placed <br />in the State Prison at Raikord, Florida; and <br />Whereas, many citizens and officials of Indian River County have written and other <br />wise communicated with the office of the Governor of the State of Florida, and with the office <br />of the Attorney General of Florida, and despite such communibations no action has been taken <br />whereby the said Johnny Smith can lawfully be placed in the State Prison.at:'Iaiford; and <br />Whereas, the Attorney General of the State of Florida has advised an official of <br />Indian River County, Florida that the entire record with regard to the said Johnny Smith has <br />I,. <br />Iv <br />
