Deputy County Attorney Will Collins stated that this issue had come up in the last <br />couple of days and the Board cannot waive the mining regulations and all LDRs must <br />comply with Chapter 901, F.S. If the Board feels relief should be granted, the change would <br />apply countywide and must go through the public hearing process. <br />ON MOTION by Commissioner Tippin, <br />SECONDED by Commissioner Macht, the Board, <br />by a 4-0 vote (Commissioner Ginn absent), <br />unanimously granted special PD exception approval <br />with the following conditions:_ (1) that prior to the <br />issuance of an LDP, the applicant shall (a) provide a <br />detailed final landscape plan to be reviewed and <br />approved by planning staff for all of the proposed <br />buffers, and (b) provide a final design for the <br />emergency access point that is acceptable to Public <br />Works and the Department of Emergency Services, <br />and (c) obtain Traffic Engineering approval of a final <br />design for a westbound left -turn lane at the project's <br />8th Street entrance, and (d) provide compliance and <br />restoration bonds for incidental mining in the <br />amount of $30,800 and $12,300, and (2) prior to <br />issuance of a certificate of completion, the applicant <br />shall (a) construct or otherwise guarantee <br />construction of the required 8 -foot wide pedestrian <br />path along 58th Avenue, and (b) construct the <br />required westbound left -turn lane at the project's 8th <br />Street entrance; all as recommended by staff. <br />NOVEMBER 14, 2000 <br />-85- <br />BK II6PG097 <br />1 <br />
