Radke; Senior Planner, Current Development <br />October 28, 2002 <br />Florida Power and Light's Request for Special Exception Use Approval for an <br />Electrical Substation Facility <br />[SPMA-02-11-67/CDPLUS #2002080053-320171 <br />It is requested that the data herein presented be given formal consideration by the Board of County <br />Commissioners at its regular meeting of November 5, 2002. <br />DESCRIPTION & CONDITIONS <br />Mosby & Associates, Inc. has submitted an application for special exception and major site plan <br />approval on behalf of Florida Power and Light to construct an electrical substation on a ±5.00 -acre <br />site. Located at the northeast comer of the 12" Street/58' Avenue intersection, the subject site is zoned <br />RS -3 Residential Single -Family (up to 3 units per acre), and has an L-1, Low Density Residential -1 <br />(up to 3 units per acre), land use designation Special exception use approval is needed to construct an <br />electrical substation in the RS -3 zoning district. <br />While the county zoning code does not specifically list an electrical substation as an allowable use in <br />the RS -3 zoning district, the code does list "limited public and private utilities" as an allowable use in <br />the RS -3 zoning district and the definition of limited public utilities does include electrical substations <br />(see attachment #5). Therefore, for zoning purposes staff has categorized the electrical substation as a <br />limited public utilities facility and applied the limited public utilities specific land use criteria from land <br />development regulation (LDR) chapter 971 to the project. <br />At its regular meeting of October 10, 2002, the Planning and Zoning Commission voted 6-0 to <br />recommend that the Board of County Commissioners approve the special exception use request with <br />the condition contained in the recommendation at the end of this report (please see attachment #6). <br />At this time, the Board of County Commissioners is to consider the request and is to approve, <br />approve with conditions, or deny the special exception use request for the proposeo electrical <br />substation Pursuant to section 971.05 of the land development regulations (LDRs), the Board is to <br />consider the appropriateness of the requested use for the subject site and surrounding area The <br />Board may attach reasonable conditions and safeguards necessary to mitigate impacts and to ensure <br />compatibility of the use with the surrounding area. <br />November 5, 2002 <br />
