Napier, SRPA, SRAI,,,/w// <br /> Right-of-Way Agent <br /> SUBJECT : Developer' s Agreement Between <br /> Indian River County, Florida, and <br /> Laurel Builders, Inc. <br /> 58' Avenue, Phase II - County Project No. 8823 <br /> DATE : November 20 , 2000 <br /> DFSr IPTION AND CONDITIONS <br /> Note: This item is coming back to the Board due to statements added to the agreement, <br /> that were not previously approved by the Board . <br /> A drainage retention parcel is needed at the southwest comer of 58°i Avenue and 5'" Street <br /> SW in conjunction with the 58h Avenue , Phase II Improvement Project. The owner has <br /> executed a Developer's Agreement through which the 1 . 5 acre parcel can be acquired by <br /> the County. The developer would be allowed to join and expand the pond at a later date <br /> when the remainder site is developed , if desired . <br /> This request was presented to the Board on September 19 , 2000 , and was approved <br /> without a reverter clause then contained in the agreement. The agreement has been <br /> revised , deleting the reverter clause from item #2 . At the request of Laurel Builders , <br /> however, two statements have been added to item #3 , wich address repairs in case the <br /> grove irrigation is damaged , and compliance with State Citrus Canker Regulations. At the <br /> suggestion of Will Collins , we also added one statement to item #7 which requires Laurel <br /> Builders to give the County a permanent drainage easement in the event the property is <br /> re-conveyed to Laurel through the option given in item #6 . <br /> The purchase price of the AA zoned land is $27 , 000 . 00 , or $ 18 ,000 .00 per acre . This <br /> price-per-acre is comparable to other similar parcels the County has acquired based upon <br /> appraisals or evaluations .
