� . <br /> Community Development Director Bob Keating noted that Mr. Steele ' s neighbor, Mr . <br /> Downing, has been cited for illegal occupancy by the Code Enforcement Board and it is not <br /> appropriate for the Board to consider that matter at this time . <br /> County Attorney Paul Bangel recommended that the Board allow Mr . Steele to <br /> address them but let staff and the Code Enforcement Board deal with the problem . Any <br /> appeals to the Code Enforcement Board action go directly to Circuit Court and this Board <br /> would be a party to such an action . <br /> Robert Steele, 13455 79`h Street, Fellsmere , stated that he had done a lot of work to <br /> resolve this problem and asked for an explanation in layman ' s terms . <br /> County Administrator Jim Chandler clarified that the illegal occupancy issue is being <br /> handled by the Code Enforcement Board, but not the sewage and septic tank issue . The <br /> property was inspected after the last meeting and there is a bathroom in the barn and it is <br /> connected to a septic tank, which has a drainfield . <br /> Mr . Steele felt it was critical that the tank be inspected, and Administrator Chandler <br /> stated that the inspector dug down to confirm that the connection is in place and tests were <br /> run to show the waste was going into the tank . <br /> r <br /> Director Keating stated that Mr . Downing has a 5 - acre tract and built a pole barn on <br /> the property as an agricultural use . He is currently building his primary residence , but does <br /> have permitted electricity and plumbing in the pole barn . <br /> Environmental Health Director Mike Galanis advised that the new construction has <br /> been permitted and the septic tank has been inspected and approved .
