• <br />Commissioner Ginn asked if access to the stormwater area has been provided, and <br />Director Boling advised that is a standard requirement to provide maintenance access around <br />the two lakes that are proposed. More detail is required, provided, and studied at the land <br />development permit stage. <br />The Chairman opened the public hearing and asked if anyone wished to be heard in <br />this matter. There being none, she closed the public hearing. <br />ON MOTION by Commissioner Macht, SECONDED BY <br />Commissioner Adams, the Board unanimously made the <br />following findings: 1) the Board is empowered under the <br />provisions of Chapter 971 to review the special exception use <br />applied for; 2) the granting of the spacial exception use will not <br />adversely affect the public interest; 3) the application satisfies <br />the general and specific criteria required for special exception <br />approval; and 4) the conditions stated below are adequate to <br />ensure compatibility between the special exception use and <br />surrounding land uses. The Board also granted special exception <br />use and PD plan approval for The Reserve at Grand Harbor with <br />the following conditions: 1) prior to issuance of a land <br />development permit, the applicant shall; a) execute a county - <br />approved developer's agreement committing to all required off- <br />site traffic improvements, and b) enter into a county -approved <br />developer's agreement which finalizes the form of compensation <br />for the 53rd Street right-of-way to be released, and c) provide a <br />September 17, 2002 <br />57 <br />L <br />• <br />67 <br />
