0 <br />1 <br />i <br />0 <br />0 <br />357 <br />;; drainage ditch necessary in connection with construction of Job 206 of Section 8801, State s <br />Road 5, and <br />WHEREAS, a portion of said ditch is located upon lands now owned by Indian <br />River County and request having been received to grant the State of Florida the easement, <br />license and right to enter upon, excavate, construct and maintain said portion of the said <br />drainage ditch over, thraugh and across said -lands of Indian River County and said request <br />having been duly considered. <br />NOW, THEREFORE BE IT RESOLVED by the Board of County Commissioners of Indian <br />River County, Florida, that the Chairman and Clerk of said Board be and they are hereby <br />authorized and -directed to -make, execute and deliver to the State Road Deparknent an easement <br />Deed granting the State of Florida the easement, license and right to enter upon,e xcavate, <br />construct and maintain an outfall drainage ditch over, through and across the following de- <br />scribed lands now owned by Indian River County, Florida, to -wit: <br />The North 25 feet of Government Lots 7 and 8 of <br />Section 7, Township 33 South, Range 40 East <br />BE IT FURTHER RESOLVED that a certified copy of this Resolution be forwarded <br />forthwith to the State Road Department at Fort Lauderdale, Florida. <br />Upon Motion of Commissioner Waddell, seconded by Commissioner Watts°and carried, <br />Letters of Agreement were authorized relating to obtaining right of way'deeds-on State Road 5, <br />Section 8801-691 as follows: <br />October 6, 1953 <br />Mr. & Mrs. T. R. Cobb <br />Vero Beach <br />Florida <br />Dear Mr. & Mrs. Cobb: <br />In consideration of your conveyance of the right of way described in State <br />Road Department Deed No. 157-R, Section 8801-691, State Road 5, Indian River County, Florida, <br />the County agrees with you as follows: <br />1. That the County will move the palm trees in the new right of way and replace; <br />them on your property as requested. <br />2. That the County will rewire with underground electric wiring your sign which <br />you intend to place just off the new right of way line. <br />3. That the County will request the State Road Department to provide for <br />drainage through the curb and into the gutters on the new road so that your abutting property <br />will drain into the street. <br />4.
