The State of Florida's performance and obligation to pay under this Agreement is contingent upon an annual <br /> appropriation by the Legislature . The parties hereto understand that this Agreement is not a commitment of future <br /> appropriations . <br /> 5 . A. The Grantee shall submit quarterly invoices in conjunction with quarterly progress reports. The Grantee <br /> shall utilize the Progress Reporting Form, attached hereto and made a part hereof as Attachment D, for <br /> submitting its quarterly progress report. Quarterly reports shall be submitted to the Department' s Grant <br /> Manager no later than twenty (20) days following the completion of the quarterly reporting period. It is <br /> hereby understood and agreed by the parries that the term "quarterly" shall reflect the calendar quarters <br /> ending March 31 , June 30, September 30 and December 31 . The Department's Grant Manager shall have <br /> ten ( 10) calendar days to review deliverables submitted by the Grantee. <br /> B . The Grantee agrees to comply with the requirements of EPA ' s Program for Utilization of Small, Minority, <br /> and Women ' s Business Enterprises in procurement under this Agreement. <br /> 1 . The Grantee accepts the Minority Business Enterprise/Women ' s Business Enterprise <br /> (MBE/WBE) "Fair Share" goals and objectives negotiated with EPA as follows : <br /> Florida Fair Share Goals <br /> Industry Goal <br /> SRF Construction (both SRFs 11 % MBE and 3% WBE <br /> Architectural & Engineering Services 10% MBE and 15% WBE <br /> Commodities 7% MBE and 17% WBE <br /> Contractual Services 14% MBE and 36% WBE <br /> Construction non SRF 10% MBE and 11 % WBE <br /> 2 . If the Grantee does not want to rely on the applicable State ' s MBE/WBE goals, the Grantee <br /> agrees to submit proposed MBE/WBE goals based on availability of qualified minority and <br /> women-owned businesses to do work in the relevant market for construction, services, supplies <br /> and equipment. "Fair Share" objectives must be submitted to the EPA Grants Management <br /> Office, 61 Forsyth Street, Atlanta, GA 30303 within thirty (30) calendar days of award and <br /> approved by EPA no later than thirty (30) calendar days thereafter. Copies of all correspondence <br /> with EPA shall also be forwarded to the Department ' s Grant Manager. <br /> 3 , The Grantee agrees to ensure, to the fullest extent possible, that at least the applicable "Fair <br /> Share" objectives of Federal funds for prime contracts or subcontracts for supplies, construction, <br /> DEP Agreement No. G0061 , Page 3 of 10 <br />
