THE BOARD OF COUNTY COMMISSIONERS, INDIAN RIVER COUNTY, FLORIDA, RESOLVES: <br />SECTION I <br />s. <br />This Resolution shall be known and may be cited as "the Subdivision Resolution of <br />Indian River County, Florida". In its interpretation and application the provisions of this <br />Resolution shall be held to be the minimum requirements adopted for the protection of the <br />P <br />public health, safety and welfare. To protect the public, among other purposes, these provisions <br />are intended to provide.for permanently wholesome community environment, adequate services, <br />proper drainage and safe streets. This Resolution shall not apply to any land forming a part k <br />of a subdivision created and recorded prior to the effective date of this Resolution but it <br />�i <br />shall apply to any resubdividing, and shall be effective for all subdivisions which do not have', <br />preliminary approval of final plat approval one hundred and eighty days (180) from the date <br />of adoption. (See Section XII) It is not intended by this Resolution to repeal, abrogate, <br />annul or in any way impair or interfere with existing provisions of other laws or resolutions <br />except those specifically repealed by this Resolution, or with private restrictions placed <br />I' <br />B <br />upon property by deed, covenant or other private agreement or with restrictive covenants <br />running with the land to which the County is a party. Where this Resolution imposes a greater <br />restriction upon land than is imposed or required by such existing provisions, the provisions <br />of this Resolution shall control. <br />SECTION II <br />For the purposes of this Section, the following terms, phrases, words and their de- <br />rivations shall have the meaning given herein. When not inconsistent with the context, words <br />used in the present tense include the future, words in the plural number include the singular <br />number, and words in the singular number include the plural number. The word "shall" is always, <br />, <br />mandatory and not merely directory. <br />1. "County" is "Indian River County, Florida". <br />2. "Commissioners" is "Board of County Commissioners, Indian River County, Florida".' <br />3. "Final Plat" is the final map, drawing or chart on which the subdivider's plan <br />of subdivision is presented to the County Engineer and/or County Commissioners for approval, y <br />i <br />and which, if approved, will be submitted for recording. <br />4. "Lot" is a parcel or portion of land in a subdivision or plat of land, separated j <br />from other parcels or portions by description as on a subdivision or record of survey map or <br />by metes and bounds, for the purpose of sale or lease to, or separate use of, another. a <br />5. "Master Plan" is a comprehensive plan prepared by the County Commissioners <br />which indicates the general locations recommended for the various functional classes of public <br />�i <br />works, places and structures and for the general physical development of Indian River County, <br />Florida and includes any unit or part of such plan separately adopted and any amendment to sucha <br />plan or parts thereof. <br />i <br />6. "Official Map" is the map established by the County Commissioners showing the <br />streets, highways and <br />parks <br />theretofore laid out, <br />adopted and <br />established by law <br />and any amend-i�, <br />i� <br />ments thereto adopted <br />by the <br />County Commissioners <br />or additions <br />thereto resulting <br />from the i! <br />approval of subdivision plats by the County Commissioners and the subsequent filing of such <br />
