(2) In compliance with Florida Statute (Section 287.087) attached form "Drug-Free Workplace Certification" should be fully executed and submitted with bid response . (3) The Uniform Commercial Code (Florida Statutes , Chapter 672 ) shall prevail as the basis for contractual obligations between the awarded contractor/vendor and the City/County for ■ any terms and conditions not specifically stated in the Invitation for Bid . • (4) The obligations of the City/County under this award are subject to the availability 0f funds lawfully appropriated for its purpose . (5) This Invitation for Bid shall be included and incorporated in the final award . The order of contractual precedence will be the purchase order or price agreement release , bid document (original Terms and Conditions), and response . Any and all legal action necessary to enforce the award will be held in the City/County and the contractual obligations will be • interpreted according to the laws of Florida . 6. CERTIFICATION, LICENSES AND PERMITS • Vendor must include with his bid a copy of all applicable Certificates of Competency issued by the • State of Florida or the Palm Beach County Construction Industry Licensing Board and a current Occupational License for Palm Beach County in the name of the vendor shown on the bid proposal • page. If awarded contract, vendor will be required to obtain an Occupational License for the City/County. It shall also be the responsibility of the vendor to submit, prior to commencement of • work, any and all permits required to complete this contractual service at no additional cost to the City/County. i 7. SUBCONTRACTING If a vendor subcontracts any portion of a contract for any reason , he must include , in writing , the • name and address of all Minority and Non-Minority subcontractors, their telephone numbers and extent of work to be performed . This information shall be submitted with bid proposal on the ■ Schedule of Subcontractors . All Small Business Enterprise subcontractors must be listed on the Statement of Small Business Subcontractor Participation and this information submitted with bid • proposal . The City/County reserves the right to reject a bid of any bidder if the bid names a subcontractor who has previously failed in the proper performance of an award , or failed to deliver • on time contracts of a similar nature , or who is not in a position to perform under this award .
