11 . 04 It is further agreed that the providing of fire protection services by the Employer is extremely <br /> vital to the health, welfare, and safety ofthe citizens ofthe District and any interference with <br /> such services is in violation of this article and would constitute a threat of imminent danger to <br /> said citizens and possible irreparable harm. The parties agree that should the Union, its <br /> members, persons acting in the Union's behalf, agents, employees, representatives, or officers <br /> acting in the Union's behalf violate this article not to strike, which would also violate the <br /> Constitution of the State of Florida and the Florida Statutes, or picket in furtherance of a <br /> work stoppage or violate this clause in any other manner, and said action would cause the <br /> District irreparable injury or damage, and the Employer shall have the right to seek injunctive <br /> relief pursuant to Chapter 447, Florida Statutes. <br /> 11 . 05 Employees who refuse to perform the regular duties of their job because of strike, boycott, or <br /> picket line in furtherance of any work stoppage, upon the Employer's premises, or at any <br /> other place, shall be in violation of this article and subject to layoff or discharge at the <br /> discretion ofthe Employer. Such action shall be a violation ofthis article, regardless ofwhich <br /> labor organization is conducting the strike, work stoppage, picketing or labor dispute . <br /> ARTICLE 12 <br /> GRIEVANCE <br /> GRIEVANCE PROCEDURE <br /> 12 . 01 A "grievance" is a claimed violation of this agreement, including but not limited to the claim <br /> that a discharge or other disciplinary action violated a specific provision of this agreement. <br /> No grievance will or need be entertained or processed unless presented in the manner <br /> described herein, and unless filed in a manner provided herein within the time limit prescribed <br /> herein. A grievance may be filed by a bargaining unit employee or by the union. In either <br /> case, the procedure to be followed will be the same . Grievances regarding disciplinary actions <br /> shall be initially filed at Step 2 . The grievant and management may mutually agree to waive <br /> any step. <br /> 12 . 02 Rules of Grievance Processing — It is agreed that: <br /> 12 <br />
