Based on the line item for mobilization/demobilization in the Notice of Contract Award, a 60% <br /> partial payment shall be made to the CONTRACTOR upon the placement of 10,000 cubic yards of <br /> beach compatible material within the construction fill template. The remaining 40% will be paid to <br /> the CONTRACTOR upon Final Acceptance of the completed project. <br /> 37. ACCEPTANCE PROFILES <br /> All sand excavated from the borrow area shall be transported to and deposited on the beach within <br /> the lines, grades and cross-sections shown on the Plans except as may be modified following the pre- <br /> construction survey or other conditions specified in Section 31 of these Technical Specifications. <br /> The CONTRACTOR shall maintain and protect the fill in a satisfactory condition at all times until <br /> Acceptance of the work. <br /> 37. 1 Non-Negotiable. All acceptance (pay) profiles are shown in the Plans and Specifications <br /> for the project. Acceptance profiles have been established based on FDNR/FDEP and <br /> intermediate monuments at a spacing of approximately 500 feet ±50 feet. The COUNTY <br /> shall retain final decision regarding any and all issues related to pay profiles, pay volumes <br /> and any other issues pertaining to the fill quantities and acceptance profiles. <br /> 37. 2 Underfilling. The filled beach between acceptance profiles shall be graded, dressed (see <br /> Section 31 .4) and uniform in dimension. Pay profile lines shall include a minimum of 95% <br /> of the design fill, as calculated by the COUNTY, and the fill must meet the lines and grades <br /> of the template shown on the Plans. The constructed beach contour lines between pay <br /> profiles shall be approximately parallel and straight, indicating the CONTRACTOR' S best <br /> effort to construct a uniform (non-cuspate) beach between the profile lines. If the <br /> COUNTY observes underfilling between pay profile lines, or scarping from a previously <br /> Accepted Section, additional surveys shall be conducted by the CONTRACTOR to <br /> quantify the fill in place and ensure a uniform template is being maintained between profile <br /> lines. In order to qualify for payment of that section, the CONTRACTOR shall place <br /> additional fill until the beach is uniform in appearance and dimensions between pay profile <br /> lines. <br /> 37.3 Adjustments for an Increase or Decrease in Work in Excess of 25%. If any change ordered <br /> by the COUNTY causes an increase or decrease in the amount of the Work exceeding 25 % <br /> of the estimated volumetric quantities to be placed within construction templates as <br /> specified by the Contract Documents, then the COUNTY and CONTRACTOR shall <br /> execute a written supplemental agreement covering the additional or reduced work. The <br /> COUNTY has the right to modify the project to meet the bid amount agreed upon by the <br /> COUNTY and the CONTRACTOR. The CONTRACTOR shall be responsible for insuring <br /> that such additional work is covered under a performance and payment bond. <br /> 37.4 Final Completion. The final completion date shall be the date of completion of all work <br /> called for in the Contract Documents.
